This policy explains how Sustainergy LTD (UK) and Sustainergy B.V. (NL) (together, “Sustainergy”, “we”, “us”) process personal data via sustainergysolar.com, our customer portal, and our sales/CRM systems.

1. What data we collect

• Identification and contact details (name, job title, company, email, phone).

• Account and transaction data (quotes, orders, deliveries, invoices, payment status).

• Website/portal data (IP, device, pages viewed, cookie identifiers, preferences).

• Communications (emails, messages, call notes)

 

We do not intentionally collect special category data and our services are B2B; not directed to general public.

• Directly from you (forms, email, WhatsApp, phone, events).D

• From your organisation colleagues.

• From service providers (credit/factoring, KYC providers), and public business sources (e.g., company registers).

3. Why we use your data (Purposes & Legal Bases)

• To provide quotes, fulfil orders, deliver goods, manage accounts and credit (Contract, Art. 6(1)(b) GDPR / UK GDPR).

• To maintain our CRM/ERP, prevent fraud, and protect our rights (Legitimate Interests, Art. 6(1)(f)).

• To comply with tax, accounting, sanctions and export laws (Legal Obligation, Art. 6(1)(c)).

• To send B2B marketing you would reasonably expect in your role, with an opt-out at any time (Legitimate Interests) or Consent where required.

• To use non-essential cookies/analytics (Consent) via our cookie banner.

4. Sharing & International Transfers

We share data with processors strictly as needed: hosting/IT, CRM/ERP, email/marketing platforms, delivery and logistics partners, payment/factoring (e.g., invoice finance), analytics, and professional advisers. Some providers are outside the UK/EEA. Where we transfer data internationally, we use EU Standard Contractual Clauses, the UK IDTA/Addendum, and—where applicable—the EU-US/UK-US Data Privacy Framework.

 

5. Retention

• Customer/accounting records: 7 years (tax law).

• Sales enquiries and CRM leads: up to 24 months from last interaction.

• Support tickets/comms: 12–24 months depending on context.

• Cookies: per our Cookie Policy/consent settings.

6. Your Rights

You may access, rectify, erase, restrict or object to processing, and request data portability. You can withdraw consent at any time without affecting prior processing. To exercise rights, email privacy@sustainergysolar.com.
You also have the right to complain to a supervisory authority: the ICO (UK) or your local EU authority (e.g., Autoriteit Persoonsgegevens in NL).

7. Security

We apply technical and organisational measures appropriate to risk, including access controls, encryption in transit, least-privilege policies, MFA on admin systems, and supplier due diligence.

8. Automated Decisions / Profiling

We do not make decisions producing legal or similarly significant effects solely by automated means. We may segment B2B contacts to personalise communications; you can object at any time.
